Description: This layer depicts the boundaries of the Atlantic Surf Clam and Ocean Quahog Environmental Degradation Closures for the NOAA Fisheries Service’s Greater Atlantic Regional Fisheries Office (GARFO). It includes five regulated areas which are off limits to surf clams and ocean quahogs due to the presence of harmful contaminants. The Georges Bank Closure was implemented in 1990 at the recommendation of the Food and Drug Administration (FDA) after clams were found with high levels of the toxin that causes Paralytic Shellfish Poisoning (PSP). However in 2012, NMFS opened a portion of the Georges Bank Closure east of Cape Cod after ongoing testing demonstrated the shellfish are safe for human consumption. Other closures in this layer depict waste disposal sites for metropolitan areas. This dataset is from NMFS and represents areas and regulations mandated in the U.S. Code of Federal Regulations (CFR). Description: NOAA Fisheries implemented the Atlantic Large Whale Take Reduction Plan (ALWTRP) to reduce injuries and deaths of humpback, fin, and right whales due to incidental entanglement in fishing gear from Maine to Florida. The ALWTRP is an evolving plan that changes as NOAA Fisheries learns more about why whales become entangled and how fishing practices might be modified to reduce the risk of entanglement. The current Plan includes restrictions on where and how gear can be set, including closures and gear modifications such as use of sinking groundline and weak links, trap minimums, and gear markings. Other components of the Plan include research on whale populations, whale behavior, and fishing gear interactions; outreach to inform and collaborate with fishermen; and a disentanglement program. The ALWTRP applies to certain gillnet and trap/pot fisheries. ALWTRP regulations apply to all U.S. waters in

Description: In June 2019, the New England Fishery Management Council adopted Research Objectives for the Great South Channel Habitat Management Area. The Council’s intent was that both fishermen and scientists will work toward obtaining better information to define where Atlantic surf clams and mussels can be harvested without impacting sensitive fish habitat in those areas. These areas are a part of the New England Fishery Management Council's Clam Dredge Framework. Rose and Crown and Davis Bank East were identified by the Council as two areas where exemptions might be identified through a future action and research could be conducted. Both areas have Atlantic surf clams in harvestable quantities, and the Rose and Crown area is known to have mussel beds. Overall, little is known about the mussel resource in the GSC HMA, and beds may be present in the Davis Bank East area as well. Both areas have structured benthic habitats of interest from a conservation perspective. Four objectives, management applications, and a research framework for these areas are described in the Council’s <a href="https://s3.amazonaws.com/nefmc.org/190612-GSC-HMA-Research-Planning-Document.pdf" target="_blank">Research Objectives for the Great South Channel Habitat Management Area</a> document.
Description: NOAA Fisheries designated coral protection areas on Georges Bank and in the Gulf of Maine in June 2021. Under the discretionary provisions for deep-sea coral protection in the Magnuson-Stevens Fishery Conservation and Management Act, the New England Fishery Management Council (NEFMC) developed this action to reduce the impacts of fishing gear on deep-sea corals after considering long-term sustainable uses of the fishery resources in the area. The NEFMC process took several years and included a high-degree of public input in the development of the final protection areas and associated measures. Deep-sea corals are important sources of habitat for many species of fish and invertebrates, including commercially important fish species. This action:
<ul> <li>Establishes the Georges Bank Deep-Sea Coral Protection Area. This area is on the outer continental shelf in New England waters. It complements the Frank R. Lautenberg Deep-Sea Coral Protection Area established by the Mid-Atlantic Fishery Management Council in January 2017.</li>
<li>Prohibits bottom-tending commercial fishing gear (with the exception of red crab pot gear) in the Georges Bank Coral Protection Area to protect deep-sea corals.</li> <li>Designates the Mount Desert Rock and Outer Schoodic Ridge Coral Protection Areas in the Gulf of Maine. Vessels are prohibited from fishing with bottom-tending mobile gear in these areas. Vessels are still able to fish for lobster in these areas using trap gear.</li>

Description: The range for the monkfish fishery is the EEZ north of the North Carolina/South Carolina border (Maine through North Carolina). However, there are two separate management areas within that range based on different fishing activity/operations between the two areas: the Northern Fishery Management Area (NFMA) and the Southern Fishery Management Area (SFMA). The boundary between the NFMA and the SFMA runs south along the 70° W longitude line from the south-facing shoreline of Cape Cod, MA, to 41° N latitude, then eastward to the U.S.-Canada maritime boundary. There are also two closed areas affected monkfish vessels. Description: The Endangered Species Act (ESA) requires the designation of critical habitat for a listed species when it is “prudent and determinable.” Critical habitat designations must be based on the best scientific data available and must occur in an open, public process within specific timeframes. Before designating critical habitat, consideration must be given to economic, national security, and other relevant impacts. The Secretary of Commerce may exclude an area from critical habitat if the benefits of exclusion outweigh the benefits of designation, unless exclusion will result in the extinction of the species concerned. Description: On February 5 2024, NOAA Fisheries <a href="https://d23h0vhsm26o6d.cloudfront.net/240205-Final-Rule-HAPC-2024-02239.pdf" target="_blank">published a final rule</a> to implement the New England Fishery Management Council’s (NEFMC's) Framework Adjustment that identifies a Habitat Area of Particular Concern (HAPC) offshore of Southern New England. This rule adjusts the following fishery management plans: Northeast Multispecies; Atlantic Sea Scallop; Monkfish; Northeast Skate Complex; and Atlantic Herring. The HAPC is within and around wind lease areas in Southern New England, including Cox Ledge, to focus conservation recommendations on cod spawning habitats and complex benthic habitats that are known to serve important habitat functions to Council managed fishery species. The HAPC designation is effective as of March 6, 2024.

HAPCs support the development of conservation measures through the Essential Fish Habitat (EFH) consultation process by providing focal locations and habitat types where the Council recommends an especially hard look at the impacts of federally permitted activities. HAPCs designated by the NEFMC do not directly restrict fishing or non-fishing ocean activities, but actions to avoid, minimize, or mitigate impacts on habitats are strongly encouraged within HAPCs. HAPCs provide a clear indication of the value the Council places on specific habitat types and functions, and underscores recommendations to protect such habitats from impacts. Description: This map shows critical habitat for the Northwest Atlantic Ocean Distinct Population Segment (DPS) of the loggerhead sea turtle (Caretta caretta) within the Atlantic Ocean and the Gulf of Mexico pursuant to the Endangered Species Act of 1973, as amended (ESA). Specific areas for designation include 38 occupied marine areas within the range of the Northwest Atlantic Ocean DPS. These areas contain one or a combination of habitat types: Nearshore reproductive habitat, winter area, breeding areas, constricted migratory corridors, and/or Sargassum habitat. Critical habitat for loggerhead terrestrial areas (nesting beaches) is defined separate from the ocean areas by the U.S. Fish and Wildlife Service (USFWS).
